BOOKING TERMS

Please Read Carefully Before Booking

1. By agreeing to book a session with me, you are agreeing to the following terms hereafter:

 

2. A deposit will be required to reserve a session or my services for a future date.

a. Deposits will be paid via the online checkout or an invoice. If agreed upon, Cashapp or Zelle will be accepted.

b. The deposit is non-refundable if the client cancels. However, if I am not able to perform the requested service at the agreed time, the client will be offered the opportunity to reschedule or to be refunded in full.

c. If the client wishes to reschedule from the day and time originally agreed upon, there will be a $35 reschedule fee.

d. If there are packages listed on the website, clients will have the opportunity to either pay a deposit or pay in full, or take advantage of one of the pay-over-time options ahead of the shoot.

 

3. The remaining balance will be due by the end of the shoot. Payments can be made via the invoice, or Cashapp & Zelle if agreed prior to the shoot.

a. If there are packages listed on the website, clients will have the opportunity to take care of the payments online.

b. No photography will be released to the client and no rights to images are granted until timely payment is made in full.

c. Larger projects may be subject to partial payments at designated intervals as defined by the Photographer and Client. For example, a 3 payment structure could look as follows: Payment 1- Deposit (to lock in session), Payment 2 - Post-shoot (after the shoot is completed), Payment 3 - Pre-delivery (when content is ready to be sent to client).

 

4. The standard return time is up to 12 business days for all packages that are not labeled as a an [Express] Power Shoot, as well as event services, and other customize premium packages or services. This means your pictures will be returned within that time frame. How fast? Depends on the scope of the project. You may get it in a week, you may have to wait the full 12 business days.

i. [Express] Power Shoots have their own return time which can be found in the description, and whatever that time is, is what will be adhered to.

ii. For events, if requested I may provide a link to view an online gallery of the photos ahead of project completion to satisfy the possible anxiety.

a. While I am appreciative of the excitement clients can have in anticipation of receiving their images, I do not appreciate being asked 2-3 days after the shoot "when will the images be ready?" unless you have requested expedited service and I am nearing the deadline. I am always working with your best interest at heart, and I am not always able to start projects right away due to various reasons – some of which are:

i.  There is always a cue (a line of clients ahead of you).

ii. I have other obligations to tend to or higher priority business during those 12 days that may delay my start time

iii. Burn out, I sometimes require a break, to reset mentally.

iv. To ensure the best results I only edit when in the right state of mind, so as not to overlook certain details, and to make sure I am giving my best to you.

b. If more time is required to complete the project, I will reach out to you to inform you ahead of the deadline so you know what is going on. 

i. If there is good reason to believe a project will take more than the typical 12 business day, an alternate and appropriate will be discussed and agreed to with the Client.

c. You are strongly encouraged not to schedule last minute.

i. Please take my time into consideration when you book, especially when it is not an express package. ie: It is unfair to book 1 week before your birthday and expect your images to be ready. While it is not impossible, and I will alway try my best to make your date, if that is not the agreement between me and you, and there is no expedited service requested, I am not beholden to such an expectation.

ii. Providing adequate time for planning and editing yields the best results for both me and you.

 

5. Studio reservations are made after the deposit is paid, or package is purchased.

a. Studio availability is based on a first come first served basis.

b. Studio is rented by the hour, and is billed for the next hour if we go over our allotted time – please be aware of that

i. It is recommended that you arrive early, and organized so you can get ready to start shooting as soon as possible.

ii. Some of the time for the shoot is split between set up and actual shooting. depending on what the goal is, it may take a few minutes to set lights to achieve desired outcome, and so, the creative outcome is related to time required and should be considered when considering how much time you need to book.

iv. If you would like additional hours without changing your package, please let me know and it will be arranged.

v. The client is responsible for the payment of additional studio time if it is required.

 

6. For location shoots (shoots outside of the studio), a transportation fee will be charged.

a. All costs for travel to a booked event or shoot are to be paid by the client.

b. Costs may include, but not limited to:

Gas/Toll/Airfare/Uber or Lyft

Hotel accommodations for out of state and multi-day events

In-town transportation, if out of state via rental or Uber/Lyft.

 

7. If additional equipment is necessary to accomplish the goal of the project, the client will be responsible to cover the cost of acquiring the necessary equipment and tools.

8. Edits – Due to time constraints, the current standard is a limit of 3 edits per look or outfit UNLESS stated otherwise by the package.

a. Additional edits may be granted, however, they will be placed at the back of the cue, if there is one.

b. The return time is refreshed for all new edit requests.

c. You are entitled to up to 3 free revisions.

d. Standard edits consists of:

• taking care of all blemishes and tone inconsistencies

• minimal stray hair management (where and if applicable)

• removal of objects that don't belong (like a light stand/reflector if plausible)

• color grading

e. Premium edits consists of:

  • Taking care of all blemishes and tone inconsistencies

  • Fine tuning background (if shot on seamless paper)

  • Dodging and burning for a high end industry finish

  • Teeth whitening

  • Eye enhancement 

  • Stray hair management (where and if applicable)

  • Limited body adjustments if it supports the final results 

  • Removal of objects that don’t belong (if plausible )

  • Color grading 

  • Adding artificial components to execute the vision (if it is a part of the creative direction)

  • ​Creative discretion

 

f. If your package is for standard edits, it should be understood that any requests for premium remedy will be found not applicable based on jurisdiction.

g. If you wish to upgrade your edits from standard to premium, you are welcomed to do so, just let me know and it will be arranged accordingly.

i. Upgrading edits from standard to premium is subject to additional fees.

ii. Edit fees: Standard - $12 and Premium - $40. Upgrading from standard to premium will result in a fee of the difference.

h. For events: edits by default are limited to color correction due to the volume of images. If you would like specific images to be edited further, that can be arranged after. All the images will be corrected and you will get the pleasure of tossing whatever images you do not like; that means, I will not capture 200 images and offer you 50.

9. Creative discussion will be kept to a minimum until a deposit has been made or a session is paid for.

a. It is strongly encouraged that clients come with an idea in mind, at the very least, for what they want to do. I work with everyone to flush out their ideas and steer them in the right direction based on what is actually reasonable and attainable.

b. Once there is a deposit, or a package has been paid for, we will have conversations in more detail to fine tune the expected outcome of the shoot, so you are clear what to expect.

i. This applies particularly to Premium shoots, however Express Power shoots do also have room for creative exploration, however if it has to be communicated what it is that you desire so that I may fulfill it in the appropriate capacity.

 

10. COPYRIGHT – Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of MDRHONE, LLC. (In other words, the copyright of ALL the images I take  belong to me.)

a. Images may or may not be used for promotional or educational purposes, such as: online advertising, displayed on my website, displayed on my social media platforms, used for print publications etc.

b. Images may be used in before and after, and behind-the-scenes related content for advertising and educational purposes.

i. If you are uncomfortable/shy/insecure about the idea of being seen in before and after content, please disclose that below.

ii. Please understand that you are not entitled to exemption, that being said, my discretion is lenient, and I honor whatever is requested.

iii. If you fail to disclose your desire of NOT wanting to be featured in before and after content, it will be assumed you don’t mind.

 

11. WAIVER AND INDEMNIFICATION – Client and its agent’s, family members, and assignees, if any, shall indemnify, and hold harmless, MDRHONE, LLC and Michael D. Rhone from any and all claims for damages arising out of the performance of any of the services contemplated by this agreement with the exception of intentional or illegal acts.

 

12.EXTRA TIME – Any additional time spent photographing, shall be charged at the rate of $75 per hour, after the session time has expired. The photographer may elect to perform this service or refuse to do so, at his sole discretion. The client agrees to pay these services as invoiced, and may be required to pay for these services ahead of their provision.  This is separate from the studio fee which is mandatory unless the client is providing the space.

a. There is a 15 minute grace period for tardiness.

i. If for some reason I am late, you are entitled to that time in addition to your scheduled time.

ii. If you are late, please note that it does count against your total time.
 

​​13. CLIENT’S COOPERATION–  Results may vary. Deliverable items and shots are contingent upon the client performing actions and cooperating with the Photographer. The Photographer is not liable if the Client’s neglect leads to a compromise of what has been agreed upon. The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.  Please ensure that guests do not interfere with the photographer and his duty; all guests should yield to the photographer.

a. Clients are strongly encouraged to practice their poses or at least have a plan of action ahead of the shoot.

i. If you do not come with a foundation, time will have to be spent to teach, and that will eat up your time.

b. Clients are strongly encouraged to bring accessory items that will facilitate a better final outcome: (brush, comb, lipstick, edge control, hair spray, lotion, makeup etc).

 

14. DIGITAL FILES & PRINTS – All final files will almost always be sent via WeTransfer. A Google folder may be sent as a backup if that doesn’t work. Physical prints are offered only in metal.

a. I may or may not text progress images or completed images as I complete them – let me know if you want me to.

15. CLIENT USAGE/LICNESE – The Client is obtaining digital files for personal, portfolio, or business purposes, however automatic commercial use should not be assumed if that was not the initial intent of the shoot. If it is your intention to use images or video in a commercial capacity, please make sure to disclose that. With that understanding, you are free to use or share the images as you see fit as it pertains to those uses, or in whatever manner discussed in the consultation phase. However without my explicit written consent:
a. The Client shall not sell said photographs/prints.

16. By signing, you agree that you fully understand and will be bound only by the terms above. Any other terms must be agreed to in writing. Otherwise, the above terms will be considered the consolidated, exclusive terms between you and the photographer.
